GIORGIO – VARAPODIO assists companies in all phases of public procurement and concessions in order to ensure the legal security of complex contractual arrangements and competitive bidding procedures:

• Response to calls for tender (drafting of application documents, subcontracting declarations, electronic submission, etc.);
• Assistance with procurement: proofreading of the DCE, AAPC, analysis of applications and tenders;
• Requests for additional information from the contracting authorities (drafting of requests for clarification and contacts with the buyers);
• Assistance with negotiations with the buyer (representation of the contracting authority during negotiation sessions).

The firm also advises on the execution of contracts:

• Assistance to companies during the execution of contracts, in particular in the event of unforeseen circumstances, additional work, changes to the programme, assistance in discussions with the project managers, subcontracting, etc;
• Negotiation and drafting of amendments;
• Negotiation and drafting of amendments;
• Supplementary contracts, negotiated contracts for urgent matters;
• Analysis of complaints in coordination with the project owner and the project manager;
• Assistance in the event of a summary expert opinion: defence of the summary expert opinion, assistance throughout the duration of the expert opinion (drafting of the minutes of each meeting, drafting of statements to the expert)
• Penalties for delay, termination;
• Drafting of statements of claim;
• Contesting final accounts.

The firm is able to assist companies in obtaining administrative documents relating to a public procurement/concession procedure (contract documents, BPU, DPGF, bid/application analysis report) in accordance with the provisions of the code of relations between the public and the administration and to refer the matter to the Commission for Access to Administrative Documents (C.A.D.A.) in order to obtain communication of these documents in the event of refusal by the administration.

The firm represents economic operators in litigation relating to public procurement law in matters of pre-contractual summary proceedings, contractual summary proceedings, appeals for compensation, judicial expertise, ten-year guarantee, etc.
